Disclaimer: T-Mobile® and other carriers are not liable for delayed or undelivered messages.

 

  1. Warranty and Liability

Delivery of messages is subject to effective transmission by your carrier. Always Grow Personally is not responsible for delays, failures, or technical issues caused by mobile networks or third-party systems.

Participation is at your own risk. To the fullest extent permitted by law, Always Grow Personally disclaims all warranties and is not liable for any damages related to use of the Program.

  1. Dispute Resolution (AAA Arbitration)

Any dispute, claim, or controversy between you and Always Grow Personally arising from or relating to these Terms or the Program shall be resolved by binding arbitration conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • The arbitration will take place in Grand Rapids, Michigan.
  • The Federal Arbitration Act (FAA) governs this provision.
  • The arbitrator will apply the substantive laws of the State of Michigan, excluding conflict-of-law principles.

Class Action and Jury Waiver

You agree that all claims will be brought on an individual basis only and not as a class, collective, or representative action.
If a dispute proceeds in court instead of arbitration, both parties waive any right to a jury trial.

Arbitration Costs and Decision

Each party will bear its own costs and share the arbitrator’s fees equally unless otherwise required by law.
The arbitrator’s written award will be final and enforceable in any court with jurisdiction.

Confidentiality

All arbitration proceedings and related documents will remain confidential except as required for enforcement or by law.

  • You represent that you are authorized to consent to these Terms.
  • If any provision is found invalid, the remaining terms remain enforceable.
  • We may modify these Terms at any time. Updates will be posted online.
  • Continued participation after changes constitutes acceptance of the revised Terms.
